Convene Acceptable Use Policy
General
This Acceptable Use Policy (this “Policy”) describes prohibited uses of all services offered by Convene and its affiliates (the “Services”) and the website located at [ https://conveneforthecities.com ] and all associated CLIENT sites (the “Convene Site”). The examples described in this Policy are not exhaustive. We may modify this Policy at any time by posting a revised version on the Convene Site. By using the Services or accessing the Convene Site, CLIENT agrees to the latest version of this Policy. If CLIENT violates the Policy or authorizes or helps others to do so, we may suspend or terminate your use of the Services.
Convene may provide CLIENT with access to its computers, software, voicemail, email, Internet access, cellular phones, fax, and other telecommunications systems (“Technology Systems”). CLIENT understands and agrees that these Technology Systems belong to Convene (a wholly owned subsidiary of TQI Solutions), and that CLIENT is given access to help perform job duties and further Convene and CLIENT interests.
Convene shall be solely responsible for determining whether an act is acceptable, illegal, immoral, or repugnant to Convene. If CLIENT has any questions regarding potential unauthorized acts, CLIENT must seek prior approval from Convene.
Convene has not reviewed and cannot review all user content. By operating the Services, we do not imply endorsement of user content, nor do we guarantee accuracy or safety. Convene is not a publisher of and is not liable for any user content uploaded, posted, or made available via the Services.
Convene may, at its sole discretion and without notice, suspend, disable access to, or remove content that violates this, Policy. Convene shall not be liable to CLIENT for such actions, including any loss of data, profits, or goodwill (except where prohibited by law).
CLIENT is solely responsible for any material maintained, transmitted, posted, or made available using the Services. By using the Services, CLIENT affirms ownership or authorization to use and display such content.
Prohibited Use of Services
A. No Illegal, Harmful, or Offensive Use or Content
CLIENT may not use or facilitate the use of the Services or Convene Site for any illegal, harmful, or offensive purposes. Prohibited activities include but are not limited to:
- Illegal, Harmful or Fraudulent Activities: Including but not limited to child exploitation, fraudulent schemes (Ponzi, phishing), or any content or activity harmful to individuals, operations, or reputation.
- Business Integrity: CLIENT must not infringe on intellectual property rights. Using Convene systems for such activities is strictly prohibited.
- Infringing Content: Any content that violates the proprietary rights of others or links to infringing material.
- Offensive Content: Content that is abusive, harassing, obscene, or advocates hate, violence, or discrimination.
- Harmful Content: Viruses, malware, or any code meant to disrupt or damage systems, including excessive use of bandwidth or attacks on network stability.
B. No Security Violations or Network Abuse
CLIENT may not violate the security or integrity of any system. Prohibited activities include:
- Unauthorized Access: Attempting to access or breach systems without permission, using shared credentials, or unauthorized payment methods.
- Business Protection: CLIENT must use the Internet only via approved firewalls and scan all downloads for viruses.
- Interception: Monitoring network traffic without proper authorization.
- Falsification of Origin: Forging headers or sender identity.
- Unauthorized Reproduction and Use: Reverse engineering, reselling, sublicensing, or exporting any part of Convene’s software without explicit written consent from Convene or its parent company.
- Unreasonable Load: Actions that impose excessive strain on infrastructure (as determined by Convene).
C. No Spam
CLIENT may not send unsolicited messages, emails, or other communications (“spam”). This includes:
- Lists without verified consent.
- Messages that violate CAN-SPAM or local spam laws.
- Use of unauthorized unsubscribe methods.
- Misleading headers or sender information.
All recipient lists must be built through proper opt-in methods and managed responsibly to prevent spam complaints.
D. Our Monitoring and Enforcement
Convene reserves the right—but not the obligation—to monitor, investigate, and enforce this Policy. CLIENT understands there is no expectation of privacy when using Convene Technology Systems. Convene may:
- Investigate and take action against violations.
- Report illegal activity to authorities and cooperate fully.
- Remove or restrict content without prior notice.
- Apply spam filters or suspend accounts for sending spam.
- Change, suspend, or discontinue services or access.
- Modify eligibility criteria for using the Services.
E. Feedback Loops and Abuse Reporting
Convene participates in ISP feedback loops to monitor abuse reports. High spam complaint rates may result in warnings, suspension, or termination of CLIENT accounts.
F. Bounce Rates
A bounce rate exceeding 8% may result in account suspension or termination. CLIENT is responsible for maintaining clean and accurate recipient lists.
G. Plugins and Integrations
CLIENT using plugins or third-party integrations must comply with both Convene and third-party acceptable use policies. Violations may result in account suspension or deletion.
H. Reporting Violations
CLIENT agrees to report any known or suspected violation of this Policy immediately. Contact:
